1. Can I start working in a non-DOT position during the RTD process?

Yes, you can work in a non-DOT-regulated, non-safety-sensitive position while completing the RTD process. However, you cannot perform DOT safety-sensitive duties until the full process is complete.

2. What is the difference between a DOT SAP and a regular counselor?

A DOT SAP is a Substance Abuse Professional who meets specific federal training and certification requirements to evaluate and recommend treatment under DOT regulations. Regular counselors may not be authorized for DOT RTD cases.

3. Does a return-to-duty violation affect my CDL?

Not directly, but failure to complete the RTD process may result in disqualification from operating a commercial vehicle, as your employer cannot allow you to drive until you're compliant.

4. Will my employer be notified of my RTD progress?

Yes, your employer is notified of key milestones, such as your SAP evaluation, successful completion of the treatment plan, and follow-up testing plan, to ensure DOT compliance.

5. What if I switch employers during the RTD process?

Your new employer must receive documentation of your SAP assessment and follow-up testing plan. The RTD process continues, and the new employer assumes responsibility for follow-up testing.

6. Is the follow-up testing always urine-based?

Yes, under current DOT guidelines, follow-up testing must be urine-based and directly observed, regardless of previous test types or violations.

7. Can an employer fire me for a DOT violation even if I plan to complete the RTD process?

Yes. While the RTD process allows you to return to safety-sensitive work, employment decisions are up to the employer. They are not required to hold your job during the process.

8. How can I verify that a SAP is DOT-qualified?

You can ask for the SAP’s credentials and DOT qualification training records, or use trusted services that only list verified DOT-qualified SAPs in your area.
